By accessing or using our websites, software APIs, mobile applications, interactive games, healthcare tools, social channels, or security suites (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree to these Terms, you must immediately discontinue use of our Services.
1. Service Offerings & Scope
Lumior operates as a multi-vertical technology studio. Specific terms govern your use of our custom products:
- Lumior Cortex & Lingua (AI/LLM): All prompt submittals and output generations are governed by Section 4 (AI Content Licensing). We make no warranties regarding algorithmic output accuracy.
- Lumior Vitalis (Healthcare SaaS): Use of Vitalis software is governed by Section 5 (Clinical Disclaimers) and compliance agreements.
- Lumior Spark & Nexus (Dating & Social): Social spaces require strict adherence to code of conduct rules. Access limits are detailed in Section 6.
- Lumior Realm & Forge (Games & Apps): Executable software is licensed under Section 7 (Software Licensing limits).
- Lumior Sentinel (Cybersecurity): Access is monitored to defend against intrusion and secure networks. See Section 8.
2. Registration & Accounts
To access certain features of our platforms, you must set up an active account. You agree to provide accurate, updated info and to keep your credentials secure. You are fully responsible for all activities occurring under your account. If you identify unauthorized access, notify us immediately. We reserve the right to suspend accounts that display suspicious or malicious patterns.
3. Age and Eligibility Requirements
Access criteria vary depending on the vertical in use:
- General Services: You must be at least 13 years old to create a general account.
- Lumior Spark (Dating): You must be at least 18 years of age and have the legal capacity to enter into binding agreements. Registering under false dates of birth will result in permanent suspension.
- Lumior Scholar (EdTech): Educational platforms may be accessed by minors, provided registrations are established by validated educational institutions with requisite parental permissions.
4. AI Outputs and Prompts (Cortex & Lingua)
When using our AI model integrations, the following intellectual property divisions apply:
- Input Ownership: You retain ownership of all inputs, prompts, and training telemetry files you submit to our LLMs.
- Output Assignment: Lumior hereby assigns to you all rights, title, and interest in and to the outputs generated by the AI models based on your inputs.
- Representations: You acknowledge that due to the nature of machine learning, generated outputs may not be unique across different user prompts, and may occasionally contain inaccuracies or hallucinations. You are responsible for validating outputs before use.
5. Healthcare SaaS Disclaimer (Vitalis)
Not Professional Medical Advice: Lumior Vitalis provides data management, administrative tracking, and analytical algorithms designed to assist healthcare workers. Vitalis is not a medical device. It does not diagnose, treat, or offer direct clinical advice. Licensed practitioners are solely responsible for validating diagnostics and clinical decisions.
6. Social & Dating Conduct (Spark & Nexus)
We are dedicated to building safe, authentic social structures. You agree not to engage in:
- Harassment, bullying, stalking, or sending unsolicited explicit content.
- Creating duplicate or deceptive accounts (catfishing) or impersonating other individuals.
- Using automated bots, scrapers, or scripts to harvest match information or text profiles.
Violations will result in immediate suspension, IP-address restrictions, and potential referral to law enforcement when safety breaches occur.
7. Software License Grants (Forge & Realm)
Unless covered under separate licensing agreements, Lumior grants you a limited, non-exclusive, non-transferable, revocable license to install and execute our consumer applications and games (Lumior Realm) for personal, non-commercial entertainment. You may not reverse-engineer, decompile, or copy portions of our software engines without express written consent.
8. Cybersecurity Controls (Sentinel)
In operating our zero-trust system infrastructure, we reserve the right to monitor connection metadata, restrict network ranges, or block clients that exhibit malicious patterns (e.g., DDoS activity, automated vulnerability scanning, brute-forcing attempts). Sentinel protocols automatically alert network ops to isolate suspicious workloads.
9. Limitation of Liability
LUMIOR AND ITS LICENSORS PROVIDE ALL SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMIOR SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, STATUTORY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, BUSINESS, OR PROFIT OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICES.
10. Governing Law
These Terms and any dispute arising from them shall be governed and interpreted under the laws of the jurisdiction of our corporate incorporation, without regard to conflict of law principles. Any legal suit or action must be resolved in the designated courts of our home jurisdiction.
